Two Arrested in Theft Case

Two Baxter Springs men were taken into custody on Christmas Eve morning, and are now facing felony theft charges.


At approximately 9:00 a.m., on December 24th, 2014, a sheriff’s deputy was alerted to a suspicious vehicle, which matched the description of a truck believed to be involved in recent thefts of metal in rural Southeastern Cherokee County.


The vehicle was occupied by two men, who pulled into a nearby yard.


The homeowner at that location advised the deputy he did not know either man, who were then questioned by law enforcement.


As a result of that questioning, along with other evidence obtained during the investigation and suspected stolen property being located in the vehicle, both men were taken into custody and transported to the Cherokee County Jail.


Lee Murdach, 51, of Baxter Springs, remains in the Cherokee County Jail in lieu of $5,000.00 bond on allegations of Felony Theft and Possession of Stolen Property.


Henry Foote, 47, also of Baxter Springs, has since posted $8,000.00 bond after being arrested on allegations of Felony Theft, Possession of Stolen Property and Driving While Suspended.


This investigation remains ongoing and additional charges may be forthcoming.
